[Skin] CI Menu can't get focus when not called by menu (1 Viewer)

Hello,
if I click the CI menu option during live tv I can see the menu and interact with it without any problem. If the menu appears itself (for example when I try to tune on a channel that is on ppv) The menu appears but I'm not be able to interact with it (nor with keyboard or mouse). I need to Close mediaportal to close the menu
