Can you confirm that permissions are set on the directory correctly. Also what happens if you move the directory to a different location. Finally is the user your running the program as an administrator?

Sound to me that MP is being blocked from creating the live.tv file on its own, hence why you have some success when you create it yourself.

I have adminrights, in the MP setup => TV card properties => i can change te record directory to another fysical disk if i want to, but still i can't turn mytv on or off.
I can delete the directory, make a new one.. it doesn't matter at all.
