I think I may have found at little more about what is going on wiht not being able to delete some HD files. I think it may have something to do with the auto thumbnail option. I noticed that I didn't seem to have thumbnails for HD content (BBC HD programs). So I turned off the creation of thumbnails for recorded TV option. I then restarted MP and I can now delete the file that was not able to delete before.
