possible misuse of mp's graphics? (1 Viewer)

i was browsing over at my-mce.com and came across the following skin:

was permission given for them to use mp's graphics or have they just ripped them off?

Hello

First off, I got this Image from Digital Blasphemy (http://www.digitalblasphemy.com/dbgallery/1/neuron.shtml"). Before I put up any of my themes using his (or her) work, I wrote an e-mail to the author stating that I was doing so, and that if they did have a problem, to get in contact with me and I would remove all the themes that feature Digital Blasphemy's images.
The E-mail (Sent 6/28/2005 at 9:51AM CST), and it stated:

Hello

First off, I wanted to say wow! About your wallpapers that have been created. They are unbelievable.

Also, I wanted to send out a courtesy e-mail to let you know that I have used a few of your wallpapers in my work. I run www.my-mce.com, a website that offers customization of Microsoft Windows Media Center Edition. What I do is change the background on Media Center to other cool pictures, to help people customize their media center setup.

I have used a few of your pictures in my work, and they are available for download on my website, with no charge to the end user. Also, with all the pictures I have used, I have put a link back to your website in the download description, and the images themselves have not been altered, they still have your web link on the lower right hand side.

I just wanted to extend this courtesy e-mail to let you know what is going on with your work, and if you have any questions or problems with me using your work, please let me know and I will remove the downloads per your request.

Secondly, the theme that you have referenced above was made by another user that makes themes for me.

If for some reason, you feel that this is your work, or have any other problems, please either post in here, or post in the My-MCE.com forums. I don't want to get a bad rap as taking credit for other peoples work (with all the themes that use Digital Blasphemy's images, all have links back to his/her website).

I hope this clears up any problems!

hey there, that does indeed seem to be an exact replica of a Media Protal icon.

The screenshot on your forum is almost exactly the same as an MP screen if you replace the background with a D.B. image (icon, graphics, layout, the works) .

Ok, my mistake. I thought you were referring to the background image, not the icons used in that theme.

If you want, I will remove that theme, to prevent any hard feelings and possible copywrite problems, and contact the author, Suprd, and have him ask for permission before re-hosting that file.

After looking at that screen shot you provided in the post above, you are correct, it does look a lot like the icon you have in Media Portal.

Once again, I do apologize about this, and I want to get this resolved.

Ok, until this gets resolved, I have disabled the download for that theme. I did this in good faith, to show that I am serious about getting this issue resolved.

If you want, I can add something on the download description, stating something like "Some of the icons used in this theme are from Media Portal"
, with a link back to your website.

I can't speak for the MP devs but I'm sure one of them will venture out of their code caves long enough to give you some type of answer on this.

Not a problem. I hope that we can come to a friendly resolution soon about this. The theme in question is one of my more popular themes, so I hope that we can get everything worked out soon!

As for Media Portal, I am going to download it this weekend and try it out. It looks pretty sweet, and I want to see what it's all about

Once I'm finished "evaulating" it, I will write an article about it. I love Media Center, and Media Center programs, as well as Media Center alternatives.

first of all, thank you for handling this in a good way.

I tried to contact Samsonite, who did this nice little "family". But so far i got no reaction, he does not seem to be active since april this year. The best way to sort this out is imho trying to contact the MP developer team via IRC!
