1) The problem exists on both ATI cards and Nvidia Cards.
2) Vista's original evr.dll is the only fix to the problem
That tell's me that Microsoft changed how something worked and it isn't necessarily a bug. Since it happens with Nvidia and ATI it leaves me to believe that there isn't necessarily a video driver problem either.

I've just done the tests on my system (9500GT, 182.50 drivers, Vista SP2) and everything is OK in MP 1.0.2 (PDVD8 codecs) and MPC-HC rev 1043 (internal codecs), so I'm not convinced there's a general problem with nVidia cards. I'd never noticed any problem with SP1 either.
I checked the 'desktop' colour settings beforehand using LCD monitor test images to make sure that the black (and white) levels were correct - the nVidia desktop settings affect video as well as 'desktop' display, and 'application' control of the settings is disabled. The 'video' colour settings are set to the defaults.

P.S. for reference, the Vista SP2 'evr.dll' version is 6.0.6002.18005
It's in my system specs - DVI -> HDMI.
The TV is seen as a DVI device (I'm using the nVidia EDID override facility to force this, for other reasons). The nVidia control panel 'desktop' colour settings are adjusted to get the desktop black/white/greyscale/colours correct on the TV.

I'm curious: now that you're using an older EVR (albeit I'm using the SP1 one) do you have any issues, such as:
- video tearing? (I used SP1 EVR to eliminate video tearing)
- the subtitle delay of 1000ms as I am having? (I am using the SP1 EVR but still...)
